These Terms of Service ("Terms") govern your access to and use of Pulse, a firewall log analysis and network security intelligence software product ("the Software"), provided by Cybrenexes ("we," "us," or "our"), operating at cybrenexes.com. By downloading, installing, or using Pulse, you agree to be bound by these Terms. If you do not agree, do not use the Software.
Subject to your compliance with these Terms and payment of applicable fees, Cybrenexes grants you a limited, non-exclusive, non-transferable, revocable licence to install and use Pulse on hardware you own or control, solely for your internal business operations. This licence does not include the right to sublicense, resell, distribute, modify, reverse-engineer, or create derivative works of the Software.
Pulse is offered on a subscription basis with monthly or annual billing. Fees are charged in advance at the start of each billing period. All fees are non-refundable except as expressly stated in our 14-day money-back guarantee: if you cancel within 14 days of your first payment, you may request a full refund by contacting legal@cybrenexes.com. We reserve the right to change pricing with 30 days written notice. Continued use after a price change constitutes acceptance of the new pricing.
We may offer free trial access to Pulse for a limited period. At the end of the trial period, continued use requires a paid subscription. We reserve the right to modify or cancel trial offers at any time without notice.
You agree to use Pulse only for lawful purposes and in accordance with these Terms. You must not: (a) use the Software to monitor networks or systems you do not own or have explicit authorisation to monitor; (b) use the Software to facilitate illegal activity; (c) attempt to gain unauthorised access to any system, network, or data; (d) share your account credentials with unauthorised users; (e) use the Software to harass, harm, or stalk any individual.
Pulse is designed as an on-premise application. Your firewall log data is processed and stored on your own infrastructure — it is not transmitted to Cybrenexes servers. Account information (name, email, billing details) is stored securely and handled in accordance with our Privacy Policy. We do not sell your data to third parties.
Pulse and all associated software, documentation, and materials are the exclusive property of Cybrenexes and are protected by Canadian and international copyright, trademark, and intellectual property laws. © 2025 Cybrenexes. All rights reserved. Nothing in these Terms transfers any intellectual property rights to you.
We may release updates, patches, or new versions of Pulse from time to time. Updates may be delivered automatically or require manual installation. We reserve the right to add, modify, or remove features at any time. We will provide reasonable notice of material changes that affect paid functionality.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CYBRENEXES DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF SECURITY VULNERABILITIES. YOUR USE OF THE SOFTWARE IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBRENEXES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF PULSE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CYBRENEXES'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) CAD $100.
You agree to indemnify, defend, and hold harmless Cybrenexes and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Software, your violation of these Terms, or your violation of any applicable law or third-party rights.
You may cancel your subscription at any time through the customer portal at cybrenexes.com/portal or by contacting us at legal@cybrenexes.com. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent activity, or fail to pay applicable fees. Upon termination, your licence to use the Software ends immediately.
These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Edmonton, Alberta, Canada for resolution of any disputes arising from these Terms or your use of the Software.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on cybrenexes.com. Your continued use of Pulse after the effective date of the updated Terms constitutes your acceptance of the changes.
